Believe it or not, this has been done. For the life of me, I can't remember what car had this item. As you describe, it had a small diameter tube into the sump that ended just at the minimum "safe" level. The tube was connected via hose to a push button on the dash. This push button worked like a squeeze bulb. Before starting the engine, push the button and release. If the tube is in oil, there will be enough vacuum created to pull a little green widget in to a viewing window. I do not know much more about it... but it obviously requires some details in the design.
